An inheritance contract is a special legal instrument under Hungarian inheritance law. In this agreement, the testator appoints the contracting party as heir in exchange for maintenance, life annuity or care provided to the testator or to a third person specified in the contract.
Under Hungarian law, the testator may appoint the contracting party as heir in exchange for maintenance, care or a life annuity. The contract may cover the entire estate, a specified part of the estate or particular assets.
Inheritance contracts are frequently used where elderly persons wish to secure long-term care and support while also determining who will inherit their assets upon death.
The contract should clearly define the rights and obligations of the parties, the assets concerned, the maintenance, care or annuity obligations undertaken by the contracting party, and the legal consequences of non-performance.
The contract may cover maintenance, life annuity or personal care obligations. The testator may appoint the contracting party as heir with respect to the entire estate, a defined part of the estate or specific assets.
The testator may also include testamentary provisions in the inheritance contract. However, testamentary provisions made by the other contracting party in the same contract are invalid.
If the inheritance contract concerns real estate, a prohibition of alienation and encumbrance may be registered in the land registry. This can provide additional security for the contracting parties and help preserve the intended legal arrangement.
Spouses may conclude a joint inheritance contract in the same document during the existence of their marital community. Such agreements often require a comprehensive review of matrimonial property, inheritance and real estate law issues.
Under Hungarian law, a foundation may also be established in a written will or inheritance contract. In such cases, the document must contain all mandatory elements of the foundation deed, which requires careful legal drafting.
An inheritance contract may be appropriate when a person wishes to secure long-term care, support or financial assistance, while also arranging the future transfer of certain assets, a part of the estate or the entire estate.

Even if the document is handwritten by one of the parties, it must meet the formal requirements applicable to a will written by another person.

Unless the parties agree otherwise, the testator may not validly dispose of or encumber assets covered by the inheritance contract during life or by a disposition mortis causa. This does not affect the rights acquired by a third person in good faith and for consideration.
In the case of real estate, unless otherwise agreed, the contracting party may have a prohibition of alienation and encumbrance registered in the land register without a separate registration consent from the testator.
Spouses may validly conclude a joint inheritance contract in the same document during the existence of their marital community.
Unless otherwise agreed, the surviving spouse is entitled to lifelong usufruct over the apartment inherited by the contracting party and its furnishings and equipment, if the surviving spouse used them together with the testator.
The modification, termination and cessation of an inheritance contract are governed by the rules applicable to maintenance and life annuity contracts. The formal requirements applicable to the creation of the inheritance contract also apply to its modification and termination.
